网络服务提供者类型化基础上的审查义务——以拒不履行信息网络安全管理义务罪为对象

The Duty of Review on the Basis of the Classification of Network Service Providers:A Study of the Crime of Refusing to Perform Information Network Security Management Obligations

以往对网络服务提供者的类型划分不恰当,也未以作为义务区分为导向,导致了拒不履行信息网络安全管理义务罪中判断其作为义务的偏差。以作为义务区分为导向对其类型化,单一功能的网络服务提供者按照各自不同的功能进行分类后,再通过排列组合的方式衍生出各种综合功能网络服务提供者。不同类型的网络服务提供者对网络信息内容控制能力强弱不同导致作为义务有所区别,即审查义务不同。当具体案例中涉及根据其审查义务来判断是否构成该罪时,可以分析案例中所涉及的不同功能,参照单一功能网络服务提供者的审查义务来判断综合功能网络服务提供者应当承担的具体审查义务。

The previous classification of network service providers was not appropriate,and it was not guided by the distinction of the duty to act,which leads to the deviation of judging their duty to act in the crime of refusing to perform information network security management obligations.Based on the differentiation of the duty to act,the single function network service providers are classified according to their different functions,and then a variety of comprehensive network service providers are derived by permutation and combination.Different types of network service providers have different ability to control the content of network information,resulting in the differences of the duty to act,that is,different duty of review.When judging whether it constitutes the crime according to its duty of review in a specific case,we can analyze the different functions involved in the case,refer to the duty of review of a single function network service provider,and then judge the specific duty of review that a comprehensive network service provider should undertake.
