中国式法治现代化理论塑造与中国传统法文化——以荀子治国理政学说及其当代价值为例

Modernization of the Chinese-style Rule of Law and Traditional Chinese Legal Culture:An Example of Xunzi’s State Governance Doctrine and Its Contemporary Value

要使中国式法治现代化理论具有“中国风格”和“中国特色”,除了把马克思主义法治理论与中国式法治现代化的具体实际相结合,还必须将马克思主义法治理论与中国传统优秀法文化相结合。作为汉代以降两千年传统中国主流政治哲学的核心内涵,荀子的治国理政学说所包含的“大一统国家观”、仁政和民本主义观、隆礼重法的国家治理方略观、“化性起伪”的人性论与人本价值观、刚直不阿且行法至坚的劲士精神,对于当下中国式法治现代化理论的塑造具有重要启示性价值。荀子治国理政学说当代价值的生成,必须与时俱进地推进其创造性转化和创新性发展,包括从礼所建构的传统等差秩序转换为现代法治塑造的平等秩序,从民本观念转换为以人民为中心的政治理念,从君主制礼(宪)转换为民主立宪,从而寻求中国式法治现代化理论塑造与荀子治国理政学说中优秀文化元素的契合,彰显出中国式法治现代化理论的中国特色和强劲生命力。

In order to endow the Chinese-style rule of law modernization theory with“Chinese style”and“Chinese characteristics”,it is not only necessary to combine Marxist theory of rule of law with the practice of modernization of Chinese-style rule of law,but also combine Marxist theory of rule of law with Chinese traditional excellent legal culture.As the core content of mainstream Chinese political philosophy for over two thousand years since the Han Dynasty,Xunzi’s state governance doctrines hold significant enlightening value for the shaping of modernization of Chinese-style rule of law theory,which includes the concepts of“great unification”,benevolent governance and people-oriented views,state governance strategies that emphasize ritual and law,the human nature theory and humanistic values of“transforming innate nature and initiating artificial efforts,”and the strong spirit of integrity and adherence to law.The contemporary value of Xunzi’s state governance doctrines must be generated through the progressive promotion of its creative transformation and innovative development.This includes the transformation from the traditional hierarchical order constructed by ritual to the equal order shaped by modern rule of law,from the people-oriented concept to the political ideology centered on the people,and from monarchic ritual(constitution)to democratic constitution.In this way,it seeks the convergence of Chinese-style rule of law modernization theory with the excellent cultural elements in Xunzi’s state governance doctrines,highlighting the unique characteristics and robust vitality of the modernization of Chinese-style rule of law theory.
