摘要
为了解新业态劳动者职业伤害保障现状,促进快递员职业伤害保障水平有效提升,首先,对国内外新业态劳动者职业伤害保障现状进行梳理,对比不同国家和地区在快递员等新业态劳动者职业伤害保障方面的政策和制度;然后,对快递员职业伤害类型及相关保障存在的问题进行分析,得到快递员职业伤害保障机制存在的核心问题,包括劳动关系认定困难、工伤认定复杂、主体责任缺失等;最后,针对上述问题从政府职能、企业责任和工会作用3个方面提出相应的对策与建议。该研究可对我国快递员职业伤害保障机制的进一步完善提供参考,同时也可为其他行业新业态劳动者相关保障水平的提升提供借鉴。
In order to understand the status of occupational injury protection for workers in new business formats and promote effectively the occupational injury protection for couriers,a review of the current status of occupational injury protection for new industry workers both domestically and internationally is conducted,by comparing the policies and systems of different countries and regions with respect to occupational injury protection for workers in new industries such as couriers.Then,an analysis was performed on the types of occupational injuries possibly suffered by couriers and the issues associated with their protection.The key problems in the mechanism for protecting couriers from occupational injuries were identified,including difficulties in determining labor relations,complex identification of work-related injuries,and lack of primary responsibility.Finally,appropriate counter-measures and suggestions were proposed from three aspects:government functions,corporate responsibility,and the role of trade unions to address the above issues.The research results can provide reference for further improving the occupational injury protection mechanism for express delivery workers in China,and also provide reference for improving the relevant protection level of workers in new industries in other industries.
