论帮助信息网络犯罪活动罪的行为性质

The Study on the Nature of Behavior of the Crime of Aiding and Abetting Information Network Criminal Activities

立足纯粹理论视角,对于帮助信息网络犯罪活动罪行为性质的研究,呈现出曲解实践现状,忽略实践价值,欠缺理论共识等诸多缺陷。为构建符合犯罪治理需求的刑事立法,应回归“实践导向”的研究视角,从网络与现实生活融合的真实场景出发,针对帮助信息网络犯罪引发的正犯行为缺位、犯罪共同性消解、帮助行为社会危害性增强等问题和挑战,应先将“正犯行为共犯化”,再回归正犯立场,承认帮助信息网络犯罪活动罪行为性质的独立性,实现刑法对帮助行为的客观评价。

Studies on the nature of the offence of aiding and abetting information network criminal activities from a purely theoretical perspective have shown many defects,such as misinterpretation of the current state of practice,neglect of the value of practice,and lack of theoretical consensus.In order to construct criminal legislation in line with the needs of crime control,it is important to return to the“practice-oriented”research perspective,starting from the real scenario of the integration of the network and real life,and in view of the problems and challenges arising from helping information network crimes,such as the absence of the act of being a perpetrator,dissolution of the commonality of crimes,and enhancement of the social harmfulness caused by helping information network crime,namely the absence of the perpetrator,the dissolution of criminal commonality,and the increased social harm of aiding behavior.In response to these problems and challenges,it is necessary to“make the perpetrator an accomplice”before returning to the position of identifying the perpetrator and acknowledging the independence of the act of aiding and abetting information network criminal activities,so as to achieve objective evaluation of the act of assistance in the criminal law.
