轻罪治理背景下前科消灭制度的本土化构建

在刑法领域,轻罪治理是法治现代化的体现之一,而“轻罪前科消灭制度”是轻罪治理的重要内容。时代需要、宽严相济的政策、现有规定的内在弊病与标签理论分别为轻罪前科消灭制度构建提供了正当性基础。构建轻罪前科消灭制度,一方面会与前科报告制度、户籍制度、人事档案管理等相矛盾,另一方面也难以轻易达到预期效果。我国应坚持从本国国情出发,明确前科消灭适用的对象条件、实质条件、考验期等内容。在完善相关配套措施的基础上,衔接好前科消灭与现行相关制度,并在建立信息专网的同时,强化信息保护意识。
