清代司法官责任制度研究

A Study on the Responsibility System of Judicial Officials in the Qing Dynasty

优化法官责任制度是有关司法改革的重要一环,公正的法官责任制度有助于司法实践。清代在前朝基础上建立了完善的司法官责任制度,从案件审理程序开始到审判工作结尾,规定了刑事、民事、行政的追责方式,具有责任制度类型丰富、追责方式多样、附带措施齐全的特点。清代司法官责任制度的系统性与可操作性可为当下法官责任制的革新提供启迪。

Optimizing the system of judges’responsibility is an important part of judicial reform,and a fair system of judges’responsibility is conducive to judicial practice.On the basis of the previous dyn-asty,the Qing Dynasty established a perfect system of judicial officer responsibility system,from the beginning of the trial procedure to the end of the trial work,stipulating criminal,civil and ad-ministrative accountability methods,which has the characteristics of rich types of responsibility system,diverse methods of accountability,and complete incidental measures.The systematiza-tion and operability of the judicial responsibility system in the Qing Dynasty can provide inspira-tion for the innovation of the current judicial responsibility system.
