摘要
当前,互联网平台经济对平台从业人员与企业之间的劳动关系认定产生了巨大的冲击,呈现出了用工主体复杂化、证据收集困难化、劳动关系从属性弱化等特征,使得实践中此类劳动纠纷争议较大。相比于劳动者,平台企业更具优势,掌控着算法的制定权,基于维护平台从业人员与企业公平和谐的劳动关系的目的,需要对劳动关系的认定标准进行重构、优化此类纠纷的举证责任分配、扩大劳动关系认定新态势,从而解决互联网平台用工中劳动关系认定的难点问题。
In the economic environment of Internet platform,the labor relationship between platform em-ployees and enterprises has a huge impact,showing the characteristics of complicated labor sub-jects,difficult evidence collection,weakening of labor relations,etc.,which makes such labor dis-putes more controversial in practice.Compared with workers,platform enterprises have more advantages and control the formulation of algorithms.Based on the purpose of maintaining vul-nerable groups and harmonious labor relations,it is necessary to reconstruct the identification standards of labor relations by referring to advanced foreign legal systems,optimize the distribu-tion of the burden of proof in such disputes,and expand the new situation of the identification of labor relations.So as to solve the difficult problem of labor relations identification in the employ-ment of Internet platform.
