互联网平台自治的治理逻辑探究

An Exploration of the Governance Logic of Internet Platform Autonomy

数字时代互联网平台发展日新月异,平台治理也呈现出高度复杂的特征,传统治理方式作用有限,以政府规制为基础、以实现自我规制为核心的平台自治应运而生。平台自治规则在自治过程中面临合法性限度边界模糊不清的问题,本文从解析当下平台自治规则出发,剖析平台自治的治理逻辑,分析自治规则的局限性和现实需求,并通过设定平台自治的基本原则和建立事前备案制和司法审查制,以期为妥善处理平台自我规制和政府规制的关系,并构建起二者合理分工、有机衔接的良性互动机制贡献力量。

The development of Internet platforms in the digital era is changing with each passing day,and plat-form governance is also highly complex,and the traditional governance methods have limited role,so platform autonomy based on government regulation and self-regulation as the core has emerged.In the process of autonomy,platform autonomy rules face the problem of blurring the boundaries of legality limits.Based on the analysis of the current platform autonomy rules,this paper analyzes the governance logic of platform autonomy,analyzes the limitations and practical needs of the autonomy rules,and establishes a pre-filing system and a judicial review system by setting the basic prin-ciples of platform autonomy,in order to properly handle the relationship between platform self-reg-ulation and government regulation,and construct a benign interaction mechanism with reasonable division of labor and organic connection between the two.
