药品的质量与价格关乎国计民生,有效维护药品采购市场公平竞争,能够最大程度保证药品质量,促进药品价格合理形成,保护广大患者权益。然而,我国药品采购领域滥用行政权力排除、限制竞争的行为时有发生。在该领域,公平竞争审查制度的作用常被虚置,这会破坏药品采购市场的公平竞争环境,动摇竞争政策基础地位,影响采购药品质量,最终危害人民群众的生命健康,并损害医药产业可持续发展。药品采购领域公平竞争审查虚置的原因多样,主要包括公平竞争审查制度设计不完备、审查机构决策目标偏倚、审查人员专业能力欠缺、面临严峻的企业非法寻租风险。因此,未来应该优化公平竞争审查制度设计、建立公平竞争审查制约机制、提高公平竞争审查机构专业能力、严控企业非法寻租风险,以此促进药品采购领域公平竞争审查制度有效落实,夯实竞争政策基础地位。

The quality and price of drugs are related to the national economy and people's livelihood.Only by maintaining fair competition in the drug procurement market can the quality of drugs be guaranteed to the greatest extent and promote the reasonable formation of drug prices.However,in the field of drug procurement in China,the fair competition review system is often not performed.This will seriously damage the level playing field in the drug procurement market,shake thefundamental status of the competition policy,seriously affect the quality of the purchased drugs,seriously harm the life and health of the people,and seriously damage the sustainable development of the pharmaceutical industry.There are various reasons for non-execution of fair competition review in the field of drug procurement in China,including incomplete design of fair competition review system,bias of decision-making objectives of examination institutions,lack of professional ability,and severe risk of illegal rent-seeking by enterprises.Therefore,at present,we should optimize the design of fair competition review system,establish the restriction mechanism of fair competition review,improve the professional ability of fair competition review institutions,and strictly fend the risk of illegal rent-seeking of enterprises.In order to promote the effective implementation of the fair competition review system in the field of drug procurement and safeguard the fundamental status of competition policy.
