摘要
本文通过经济法的基本原理,深入分析了商品房限购政策的法理基础及其在实际实施中的问题。研究揭示了限购政策在遏制房价过快上涨、打击投机炒房行为以及保障居民基本住房需求方面的重要性。尽管限购政策在调控市场和遏制投机行为方面取得了一定成效,但也存在地方政府权力来源不明确、法律依据不足及政策灵活性和适应性不够等问题。为此,本文提出了规范限购令的制定程序、多方位定位房市投机行为及完善保障性住房政策的具体建议,以期为进一步优化限购政策提供理论支持和实践参考,促进房地产市场的健康稳定发展。
Through the basic principles of economic law,this paper deeply analyzes the legal foundation of the commodity housing purchase restriction policy and its implementation issues.The study reveals the importance of the purchase restriction policy in curbing excessive housing price increases,combating speculative housing transactions,and ensuring the basic housing needs of residents.Although the purchase restriction policy has achieved certain success in market regulation and curbing speculative behavior,it also faces issues such as unclear authority sources for local governments,insufficient legal basis,and inadequate policy flexibility and adaptability.Therefore,this paper proposes specific suggestions for standardizing the formulation process of purchase restriction orders,multi-dimensional targeting of market speculation behavior,and improving affordable housing policies.These suggestions aim to provide theoretical support and practical reference for further optimizing the purchase restriction policy and promoting the healthy and stable development of the real estate market.
