摘要
我国将保健食品确定为一种特殊食品,隶属于食品,但是保健食品与食品实际上存在较为明显的不同,在具体的行政监管中,应当考虑基于保健食品特有的功效所可能引发的安全性问题,从而进行安全性监管。当前对于安全性监管,由于对公众生命安全保障目的的弱化、相关法律法规存在不足、制度本身存在的不足使得安全性监管在实践中缺失,影响了保健食品行政监管的实践。鉴于此,应当强化保健食品行政监管维护公众生命安全保障的目的,完善《食品安全法》及相关法律的监管规定。在注册与备案双轨制下完善对于复合原料的备案注册监管,最后在有可能的情况下引入第三方监管机制,从而促进我国保健食品行政监管制度的完善,更好维护公共安全,保障保健食品市场发展。
In China,health-food is identified as a special food,which belongs to food,but there are obvious differences between health-food and food.In the specific administrative supervision,the safety problems should be considered based on the unique efficacy of health-food,so as to carry out safety supervision.However,for the current safety supervision,due to the weakening of the purpose of public life safety guarantee,the lack of relevant laws and regulations,and the deficiency of the system itself,the safety supervision is missing in practice,which affects the practice of health-food administrative supervision.In view of the above facts,it is necessary to strengthen health-food administrative supervision to maintain the purpose of public life safety,improve the food safety law and relevant legal regulations,Under the dual-track system of registration and filing,improve the filing and registration supervision of composite raw materials,and finally,if possible,introduce the third party supervision mechanism,so as to promote the improvement of the health-food administrative supervision system in China,better safeguard public safety and ensure the development of the health food market.
