摘要
通过分析某企业未按规定对工作场所进行职业病危害因素检测、评价及安排未经上岗前职业健康检查的劳动者从事接触职业病危害的作业案例,探讨复合型职业卫生行政处罚案件办理过程中的处罚主体认定、法律适用、自由裁量、法制审核、企业逃避监管手段等问题,为今后相关案件的办理提供借鉴和参考。
By analyzing a case of a enterprise failing to conduct occupational disease hazard factor detection and evaluation in the workplace according to regulations,and arranging workers who have not undergone pre employment occupational health examinations to engage in work related to occupational disease hazards,this paper explores the issues of determining the punishment subject,legal application,discretion,legal review,and enterprise evasion of supervision in the process of handling composite occupational health administrative punishment cases,providing reference and guidance for the handling of related cases in the future.
