基于SFIC模型的公民个人信息开放与保护的协同治理研究

Research on Synergistic Governance of Openness and Protection of Citizens'Personal Information Based on the SFIC Model

数据开放在带来公众知情权便利的同时,也存在着公民个人隐私暴露的风险,引发个人信息安全问题。结合数据开放的环境特点,构建有效的多主体协同治理架构,有助于推动个人信息保护的多主体协同发展。基于SFIC协同治理模型构建理论分析框架,从外部环境、起始条件、催化领导、制度设计、协同过程5个方面分别对公民个人信息保护展开分析,提出在数据开放背景下,公民个人信息保护需要构建以政府为主导,社会组织、企业、公民等多主体共同参与的协同治理架构,要加强数据开放平台建设,把握好数据开放和信息保护的相互制衡,致力提升个人信息保护能力。

While data openness brings the convenience of the public's right to know,it also carries the risk of exposing citizens'personal privacy and triggering personal information security issues.Combined with the environmental characteristics of open data,the construction of an effective multi-body collaborative governance structure can help promote the multi-body collaborative development of personal information protection.Based on the SFIC synergistic governance model,a theoretical analysis framework is constructed to analyze the protection of citizens'personal information from five aspects:external environment,starting conditions,catalytic leadership,system design,and synergistic process,and it is proposed that under the background of data openness,the protection of citizens'personal information needs to construct a synergistic governance structure led by the government,with the participation of social organizations,enterprises,and citizens,and that it is necessary to strengthen the construction of data open platforms,grasp the advantages of data openness,and promote the development of personal information security.
