ChatGPT的技术逻辑、类型化风险与法律进路

摘要 ChatGPT作为生成式人工智能的代表,凭借高度的智能性和自主性迅速出圈。不可否认,作为智能文本生成系统,ChatGPT表现亮眼,为用户带来了极致体现,但它所潜藏的风险也逐渐浮出水面。基于此,有必要对其展开系统性研究。对人工智能技术的风险分析,离不开该技术逻辑的基础论述,否则难以提出针对性建议。故而,应当首先分析ChatGPT的技术逻辑;其次按照风险的元素的累积、风险系数攀升以及风险实害的转化三个逻辑维度进行风险类型归纳;最后提出应对之策。ChatGPT应用过程中存在数据安全、算法歧视以及网络谣言等三个维度的风险,未来应当通过数据分类分级保护,技管结合的算法纠偏以及法律制度的优化进行协同治理。 ChatGPT,as a representative of generative artificial intelligence,has quickly gained popularity due to its high level of intelligence and autonomy.Undeniably,as an intelligent text generation system,ChatGPT has shown brilliant performance,bringing ultimate experience to users.However,the risks it harbors are gradually surfacing.Based on this,it is necessary to carry out systematic research on it.The risk analysis of artificial intelligence technology cannot be separated from the basic discussion of its technological logic,otherwise,it is difficult to propose targeted suggestions.Therefore,the technical logic of ChatGPT should be analyzed first;then the risk types should be summarized according to the three logical dimensions of risk element accumulation,risk coefficient rise,and risk actual harm conversion;finally,countermeasures should be proposed.There are risks in the application process of ChatGPT in the dimensions of data security,algorithmic bias,and network rumors.In the future,coordinated governance should be carried out through data classification and hierarchical protection,technical and regulatory combined algorithmic bias correction,and optimization of legal system.
