Normative Interpretation and Application Path of the Conditions of“Having a Certain Social Impact”Based on the Publicity of Administrative Penalty Decisions

基于行政处罚决定公开之“具有一定社会影响”的条件,对行政权进行必要的限制,同时有助于增强政府公信力,最大限度减少对被处罚人的不利影响。行政处罚决定由绝对公开走向相对公开基于社会转型时期政府职能的变化,也是知情权与隐私权辩证关系认识的演化,同时也因为公民权利意识的增强。对于“具有一定社会影响”的公开标准与适用路径,在综合考虑事件社会关注度、公众利益受损程度等因素的基础上,应采取分类处理、梯度公开的策略,并建立健全评估机制,以确保公开的合理性和有效性。

Based on the condition of“having a certain social impact”for the publicity of administrative penalty decisions,the necessary limitations on administrative power are imposed,while at the same time contributing to the enhancement of the government’s credibility and minimising the adverse impact on the person being punished.The shift from absolute to relative publicity of administrative penalty decisions is based on changes in government functions during a period of social transition,and the evolution of the understanding of the dialectical relationship between the right to information and the right to privacy,as well as an increased awareness of citizens’rights.With regard to the criteria for publicity and the application path of“having a certain social impact”,on the basis of a comprehensive consideration of factors such as the degree of social concern over the incident and the degree of damage to public interests,a strategy of categorisation and gradual publicity should be adopted,and a sound evaluation mechanism should be established to ensure the reasonableness and effectiveness of the publicity.
