全民健身统合立法的法理阐释与制度表达

Legal Interpretation and Expression of Legislative Integration of National Fitness

落实全民健身国家战略,建设体育强国和健康中国,需要体系化的法律制度来引领和支撑。文章通过规范分析、文献研究、比较研究等方法,认为现行全民健身相关法规体系规范林立,存在着"统合性法律缺失,协调性不够""专项性法律阙如,权威性不足"等局限,全民健身统合立法既是对当前全民健身立法实践问题的批判反思,也是继承已有法律法规实现统合、细化和补充的功能,是提高全民健身立法质量的举措。通过进一步分析认为制定全民健身统合性专项法律的立法条件已较为成熟。在制度表达上,全民健身统合性法律应是《体育法》的细化和补充以及《全民健身条例》上位法的适度法典化定位,其内容应维护公民体育权利的实现、明确全民健身多元主体的权利与义务、特殊群体的全民健身权益保障、社区全民健身用地的有效供给等。

To implement the national fitness strategy and build a strong sports country and a healthy China,systematic laws are needed to guide and support it.Through normative analysis,literature research,comparative research and other methods,this paper considered that the current national fitness related rule of law system was full of norms,and there were limitations such as“lack of integrated laws,lack of coordination”,“lack of special laws,lack of authority”and so on.The integrated legislation of national fitness was not only a critical reflection on the current national fitness legislation practice but also the function of inheriting existing laws and regulations to achieve integration,refinement and supplement.And it was a measure to improve the quality of national fitness legislation.Through further analysis,it was concluded that the legislative conditions for the formulation of the national fitness integrated law were relatively mature.In terms of institutional expression,the national fitness integrated law should be the refinement and supplement of the“Sports Law”and the moderate codification of the upper law of the“National Fitness Regulations”.Its content should focus on the value orientation of public sports rights,clarify the rights and obligations of multiple subjects of national fitness,guarantee the rights and interests of special groups of national fitness,and effective supply of national fitness land in communities.
