粤港澳大湾区跨境破产合作机制研究——以破产管理人跨境执业为视角

破产管理人是管理破产事务的专门机构,各项破产制度建设应以保障破产管理人履职为核心。构建粤港澳大湾区跨境破产合作机制,在立法层面应以专章形式规定跨境破产法律制度,逐步弱化甚至取消互惠原则,统一“主要利益中心”认定标准。在机制运作中优化破产管理人的选任与考评,确保其履职能力与水平;成立专门的破产事务管理机构,推动破产审判与破产事务相分离;以破产管理人为连接点,形成常态化府院协作运行机制,借助互联网平台打造府院联动的“一网通办”渠道。

The bankruptcy administrator is a specialized institution for managing bankruptcy affairs,and the construction of various bankruptcy systems should focus on ensuring the performance of the bankruptcy administrator's duties.Build and improve the cross-border bankruptcy cooperation mechanism in the Guangdong-Hong Kong-Macao Greater Bay Area,establish a special chapter on the legal system for cross border bankruptcy at the legislative level,gradually weaken or even cancel the principle of reciprocity,and unify the criteria for identifying the"center of main interests".Optimize the selection and evaluation of bankruptcy administrators in the operation of the mechanism to ensure their ability and level of performance;Establish a specialized bankruptcy affairs management agency to promote the separation of bankruptcy trials and bankruptcy affairs;With the bankruptcy administrator as the connection point,we will form a normalized cooperation operation mechanism between the government and the hospital,and create a single website channel for the linkage between the government and the hospital with the help of the Internet platform.
