涉外仲裁人才培养对中国式法治现代化的因应

Training the Foreign-Related Arbitration Professionals to Responses Chinese-Style Rule of Law Modernization

中国式法治现代化对涉外仲裁人才培养的特殊要求在于,其一,能够在国际商事仲裁中,践行以人类命运共同体为理念的体现真正多边主义的国际商事规则。通过良法善治保护当事人合法权益的同时,维护我国核心利益。其二,能够总结、提炼我国所提出的“一站式”国际商事争议解决模式所体现的中国智慧,在国际商事仲裁的舞台上,充分体现中国关于国际治理的声音。然而,我国目前涉外仲裁人才培养存在以下三方面问题:国际商事仲裁法学被边缘化导致涉外仲裁人才的培养目标难以实现;涉外仲裁人才培养项目缺乏差异化的课程设置;缺乏针对仲裁司法审查人才的培养。需要从提升我国目前仲裁从业人员处理涉外仲裁业务的能力,解决涉外仲裁人才短缺的一时之需;改进涉外仲裁人才培养项目课程设置,提升学生理论水平;进一步优化联合培养机制,培养学生解决国际商事争议的专业能力,这三个维度,因应中国式法治现代化对涉外仲裁人才培养的要求。

The special requirements of the Chinese-style rule of law modernization towards the foreign-related arbitration professionals include that,first,they can apply the international commercial rules that embody true multilateralism with the concept of a community with a shared future for mankind in international commercial arbitration.Through good governance of good law to protect the legal rights of parties,meanwhile protecting the core interests of our country.Second,they can summarize and refine the Chinese wisdom embodied in the“one-stop”international commercial dispute resolution model,and fully reflect China's voice on international governance in the arena of international commercial arbitration.However,there are three problems in the training of foreign-related arbitration professionals.Firstly,the marginalized international commercial arbitration law makes it difficult to achieve the goal of training foreign-related arbitration professionals.Secondly,foreign-related arbitration professionals training programs lack of differentiated curriculum.Thirdly,there is a lack of training for professionals to judicial review the foreign-related arbitration.It is necessary to improve the ability of arbitrators,arbitration secretary and judges charge for judicial review the foreign-related arbitration to solve the temporary need of professional shortage of foreign-related arbitration.Moreover,the curriculum of foreign-related arbitration professionals training programs should be adapted to enhance students'theoretical level.Furthermore,the joint training mechanism shall be improved in order to cultivate students'professional ability to resolve international commercial disputes.Above mentioned three dimensions are in line with the requirements of the Chinese-style rule of law modernization for the cultivation of foreign-related arbitration professionals.
