摘要
基于数字化转型的时代需求,破产重整信用修复的立法体系不完善、信息治理能力不足、监管监督机制不健全等问题成为破产重整企业信用体系化修复的掣肘。云原生架构的分布式架构、devops、去信任化等技术特性与破产重整企业信用修复的体系化构建逻辑耦合。在现有的信用监管与立法框架下,借助“AI赋能”的热潮,提高破产重整企业信用修复结果的公信力、提升破产重整企业信用修复信息治理能力并重塑破产重整企业信用修复监督管理监管秩序,加速构建体系化的破产重整信用修复制度,加速推进破产重整企业的“涅槃重生”。
In the era of digital transformation,the inadequacies in the legislative system for credit restoration during bankruptcy reorganization,insufficient information governance capabilities,and incomplete regulatory supervision mechanisms have become obstacles to the systematic restoration of credit for bankrupt enterprises.The technical characteristics of cloud-native architectures,such as distributed architecture,DevOps,and trustlessness,are coupled with the logical framework of systematic credit restoration for bankrupt enterprises.Within the current credit regulatory and legislative framework,leveraging the trend of"AI empowerment"can enhance the credibility of credit restoration outcomes for bankrupt enterprises,improve information governance capabilities,and reshape the supervision and regulatory order of credit restoration.This accelerates the establishment of a systematic credit restoration system for bankruptcy reorganization and promotes the"rebirth"of bankrupt enterprises.
