终身学习立法的实践基础、价值取向与推进路径——基于终身教育治理的视角

Practical Basis,Value Orientation and Promotion Path of Lifelong Learning Legislation--Based on the Perspective of Lifelong Education Governance

教育治理,法治先行。终身学习立法本应在终身教育治理中发挥先导作用,但由于立法进程缓慢,终身教育治理思想反而“倒推式”提供了立法价值取向定位的参考框架。基于终身教育治理的保障个体学习者权利、优化教育系统内学习支持环境和优化社会大系统学习支持环境三个维度,终身学习立法的价值取向可以从保障公民学习权的“终身性”、重构教育系统的“融通性”和推动协同发展的“跨界性”进行理解。基于上述分析,终身学习立法要在强化终身学习权保障的薄弱环节,融通教育类型之间的发展壁垒,破解跨部门资源整合的现实困境等方面持续推进。

In the context of educational governance,the rule of law holds paramount importance.Lifelong learning law should have played a pioneering role in lifelong education governance,however,due to the sluggish legislative process,the determination of the legislative value orientation has been retroactively influenced by the concept of lifelong education governance.Based on the three dimensions of lifelong education governance,namely,guaranteeing the rights of individual learners,optimizing the learning support environment within both the education system and the socail system.The value orientation of lifelong learning legislation can be comprehended through its emphasis on ensuring citizens'lifelong right to learn,integrating the education system,and promoting cross-sector collaboration.Based on the above analysis,the lifelong learning legislation should address the weaknesses in the protection of the right to lifelong learning,overcome barriers between different types of education,and resolve the practical dilemmas in the integration of cross-sectoral resources.
