公共事件中行政执法的优化路径研究——以奶业事件为例

Research on the Optimization Path of Administrative Law Enforcement in Public Events--Taking the Dairy Industry Incidents as Examples

中国共产党第十八届中央委员会第三次全体会议确定推进国家治理体系和治理能力现代化作为全面深化改革的总目标。行政执法视为国家治理效能的重要表现,其何以在公共事件中彰显,成为当下社会发展亟需重视的现实问题。从三鹿奶粉事件到麦趣尔牛奶事件,行政执法仍面临一定冲突:一方面,社会公共利益与公民个人权利之间存在某种张力;另一方面,执法制度的稳定性难以应对公共事件复杂性的旁逸斜出。因此,本文建议由刚性执法转向柔性执法、从传统执法转向创新执法的路径优化,确保行政执法制度优势转化为治理现代化优势。

The Third Plenary Session of the 18th Central Committee of the Communist Party of China established the modernization of the national governance system and governance capacity as the overarching goal for comprehensive deepening of reforms.Administrative enforcement is a critical indicator of national governance efficacy,highlighting its significance in today’s society.This is especially evident in public incidents such as the Sanlu milk powder crisis and the Maquieur milk crisis,where administrative enforcement still face certain challenges:the tension between public interest and citizen rights,and a string of public struggles due to the instability of enforcement mechanisms.In light of the above issues,this paper suggests an optimized approach that shifts from rigid law enforcement to flexible law enforcement,and from traditional law enforcement to innovative law enforcement,in order to ensure that the administrative law enforcement system is transformed into the modern governance.
