电子数据完整性审查的偏误、成因及其改善进路

数据的完整性审查是电子数据审查的重要内容,但在司法实践中却存在偏误现象,主要表现为完整性要素审查不充分、完整性审查替代了合法性审查以及内容真实性审查反制了完整性审查等。究其原因,一是电子数据完整性审查存在技术复杂性,二是电子数据合法性审查规则以完整性审查为核心内容,三是电子数据完整性审查的独立程序缺位。有鉴于此,未来应当发挥专家在电子数据完整性审查中的专业作用,帮助法官实现电子数据完整性的实质性审查;同时,应梳理电子数据完整性与合法性的审查规则,理清两者的审查范畴;最后,还应构建电子数据完整性审查的独立程序,防止电子数据完整性审查偏误的发生。

Data integrity review is an important part of electronic data review.However,there are bias phenomena in judicial practice,mainly manifested as insufficient review of integrity elements,replacement of legality review by integrity review,and counteraction of integrity review by content authenticity review.The reasons for this are twofold:firstly,the technical complexity of electronic data integrity review;secondly,the core content of electronic data legality review rules is integrity review;thirdly,there is a lack of independent procedures for electronic data integrity review.In view of this,experts should play a professional role in electronic data integrity review in the future,helping judges achieve substantive review of electronic data integrity.Meanwhile,the review rules for electronic data integrity and legality should be sorted out,and the scope of both reviews should be clarified.Finally,an independent procedure for electronic data integrity review should be established to prevent errors in electronic data integrity review.
