“枫桥式检察室”融入基层社会治理的功能定位与路径优化——以J市“枫桥式检察室”建设为样本

在基层社会治理法治化的背景下,“枫桥式检察室”建设融入基层治理是形势使然、发展所需和职责所在。以嵌入式治理为思维框架,“枫桥式检察室”通过理念嵌入、职能嵌入、资源嵌入助力基层社会的有效治理,构建基层治理中的法律监督逻辑。具体是以“五类职能+特色职能”为模式,通过“以案引治、修复利治、协同共治、建议助治、引导自治”的综合型治理与“特色促治”的专业型治理予以嵌入。在路径优化方面,“枫桥式检察室”要以顺畅的内部规范和协同制度融入党委领导、政府主导、群众自治的基层治理体系;提高服务人民群众、党委政府法治决策的能力,展现法律监督同步性效能;深化数字检察,完善类案治理,精准做好群众矛盾纠纷“解压阀”“缓冲器”;加强组织保障,通过改进绩效评价、加强队伍建设等方式,持续夯实工作基础。

Under the background of legalization of social governance at the grassroots level,the construction of “maple bridge type procuratorate” into the grassroots governance is the situation,development needs and responsibilities.With embedded governance as the thinking framework,the “Procuratorial Office in Fengqiao Style” contributes to the effective governance of grassroots society through the embedding of ideas,functions and resources,and builds the legal supervision logic in grassroots governance.Specifically,it is based on the system of “five functions+characteristic functions”,through the integrated governance of “guiding by case,restoring and benefiting governance,cooperating and co-governing,proposing and supporting governance,guiding autonomy” and the professional governance of “promoting governance with characteristics”.In terms of path optimisation,the “Fengqiao Procuratorate” should integrate into the grass-roots governance system of Party committee leadership,government leadership and mass autonomy with smooth internal norms and cooperation systems;improve the ability of Party committees and governments to serve the people and make decisions under the rule of law,and demonstrate the effectiveness of simultaneous legal supervision;Deepen digital inspection,improve the management of class cases,and do a good job in the “decompression valve” and “buffer” of contradictions and disputes among the masses;Strengthen organizational support,and continuously consolidate the work foundation by improving performance evaluation and strengthening team building.
