电商平台权力滥用的法律规制

Legal Regulation of Power Abuse of E-commerce Platform

电子商务平台作为电子商务活动开展的必需设施,在电子商务活动发展过程中,通过市场支配力量和掌握的技术优势,逐渐拥有了不同于传统私权利和公权力的“私权力”。以强制平台内经营者进行“二选一”、封禁屏蔽其他平台经营者、平台经营者的自我优待行为为代表的电商平台权力滥用行为,不仅损害了平台内经营者和消费者的合法权益,更有危害市场经济竞争秩序之虞。在规制电商平台权力滥用的实践中,仍存在对电商平台权力滥用行为的性质认定不清的问题,应明确该行为属于经济法规制范畴。现有法律规制过程中,适用《反垄断法》时在市场支配地位的认定中,应结合电商平台规模效应和锁定效应的特点,重点考虑点击量及持续的时间。对于《电子商务法》,一方面要划定“不合理限制”的具体内涵,另一方面补充对电商平台的封禁行为和自我优待行为的专条立法。

E-commerce platforms,as the necessary facilities for the development of e-commerce activities,in the process of the development of e-commerce activities and through the dominant market power and technological advantages they have mastered,have gradually possessed the“private power”,which is different from traditional private rights and public power.The abuse of power of e-commerce platforms,represented by forcing operators on the platform to make“two choices”,blocking and shielding other platform operators,and self-preferential behaviors of platform operators,not only harms the legitimate rights and interests of operators and consumers on the platform,but also threatens the order of competition in the market economy.In the practice of regulating the abuse of power of e-commerce platform,there still exists the problem of unclear identification of the nature of the abuse of power of e-commerce platform.It should be made clear that the behaviour belongs to the scope of the regulation of economic law.In the regulation process of existing legislation,when applying the Anti-Monopoly Law and being in the determination of market dominance,the characteristics of the scale effect and lock-in effect of e-commerce platforms should be combined with the focus on the number and the duration of the clicks.For the E-Commerce Law,on the one hand,it is necessary to delineate the specific connotation of“unreasonable restriction”,and on the other hand,it is necessary to supplement the legislation with specific articles on the blocking behaviour and self-preferential behaviour of e-commerce platforms.
