数字经济下,商与农的互联互促衍生了“数商兴农”工程,其实施对于当下农村电商纵深性、可持续性发展具有重要赋能效应。而在农村电商的发展过程中,囿于法律的滞后性、监管的局限性及经营主体法律意识淡薄等因素使得假冒伪劣商品、非法经营等刑事风险相伴而至。因此,在农村电商高质量发展过程中,应树立前瞻意识,防范刑事风险发生。通过增设刑法罪名不仅可以加强农村电商平台经营者的监管责任,同时填补了《电子商务法》中对无须进行市场主体登记的交易主体的监管空白。应强化认罪认罚从宽制度在农村电商领域的适用,树立预防性理念与必要的处罚理念相结合的农村电商刑事制裁理念;构建多元主体监管模式,运用多种手段提升农村电商运营主体的刑事风险防范意识。激活农村电商发展潜能的同时防范刑事风险,助力乡村振兴。

Under the digital economy,the interconnection between"business"and"agriculture"has given rise to the digital business rejuvenation project,and the implementation of the digital business rejuvenation project has released a strong enabling effect on the in-depth and sustainable development of rural e-commerce.However,in the development process of rural e-commerce,due to factors such as the lag of the law,the limitations of supervision and the weak legal awareness of rural e-commerce operators,criminal risks such as counterfeiting and shoddy products and illegal operations are accompanied.In the process of high-quality development of rural e-commerce,forward-looking awareness should be established to prevent the occurrence of criminal risks.It can strengthen the regulatory responsibility of e-commerce platform operators by adding criminal law charges.At the same time,it fills the regulatory gap in the E-Commerce Law for trading entities that do not need to be registered as market entities.Strengthen the application of leniency for those who admit guilt and accept punishment in the field of rural e-commerce.Establish the concept of criminal sanctions for rural e-commerce that combines the concept of prevention and the concept of necessary punishment.Construct a multi-subject supervision model,and use multiple means to enhance the awareness of criminal risk prevention of rural e-commerce operators in the top-level design to help the sustainable development of rural e-commerce,and build local brands.Activate the development potential of rural e-commerce while preventing criminal risks,help rural revitalization,and promote Chinesestyle modernization.
