摘要
在专利数据库中对冬虫夏草发明专利进行检索,并就检索结果分析专利申请数量、专利有效性及申请人排名和构成等。结果认为,受冬虫夏草人工培育及加工技术发展、专利审核制度、新冠疫情等因素的影响,我国冬虫夏草专利申请数量处于下降趋势,且整体法律状态(有效率)偏低;同时专利申请人已转为以企业为主,其特点是专利申请的持续性不强。通过综述蝙蝠蛾幼虫饲养、中国被毛孢扩繁、蝙蝠蛾幼虫侵染、冬虫夏草子实体培育和冬虫夏草加工等技术领域的专利情况,分析冬虫夏草产业的创新发展。最后提出存在的挑战并给出针对性的建议。
The invention patents of Ophiocordyceps sinensis were searched and analyzed in the patent database,including the number of patent applications,patent validity,and the ranking and composition of applicants.The result showed that there was a downward trend in the number and a low overall legal status of patent applications for O.sinensis in China,due to the influence of factors such as the development of artificial cultivation and processing technology of O.sinensis,the patent review system,and COVID-19.At the same time,patent applicants had shifted from individuals to enterprises,which was characterized by weak sustainability of patent applications.This article analyzed the innovative development of the O.sinensis industry by summarizing the patent situation in the fields of bat moth larvae breeding,Hirsutella sinensis propagation,bat moth larvae infection,O.sinensis fruiting body cultivation,and O.sinensis processing.Furthermore,the existing challenges and targeted recommendations were also raised.
