摘要
数字信息时代下用人单位利用信息化的便利,在非工作时间在线安排劳动者完成工作任务,导致劳动者生活时间与工作时间的界限模糊。为保障劳动者的休息权利和财产权利,营造和谐有序的用工环境,需要从劳动者离线权视角予以考量。但是,当前我国法律并未为劳动者设立离线权,劳动者离线工作时长难以计算,“谁主张谁举证”原则以致维权艰难,离线权与企业权利存在冲突等问题,使得劳动者离线权难以实现。对此,可以借鉴别国离线权成功经验,将离线权纳入立法进程,完善集体合同制度和离线加班时长计算规则,引入惩罚性赔偿和举证责任制度,完善单位管理制度等多个层面探究劳动者离线权实现路径。
In the digital information age,employers utilize the convenience of informatization to arrange workers to complete work tasks online during non-working hours,resulting in a blurred boundary between workers’living time and working time.To safeguard the rest and property rights of workers and create a harmonious and orderly employment environment,it is necessary to consider it from the perspective of workers’offline rights.However,the current laws in China have not established offline rights for workers,making it difficult to calculate the offline work hours.The principle of“who advocates,who proves”makes it difficult to protect workers’rights.And the conflicts between offline rights and enterprise rights make it difficult for workers to realize their offline rights.In this regard,it’s suggested to learn from the successful experience of offline rights in other countries,incorporate offline rights into the legislative process,improve the collective contract system and the calculation rules for offline overtime hours,introduce punitive damages and burden of proof systems for units,and improve unit management systems to explore the implementation path of workers’offline rights at multiple levels.
