摘要
“人工智能+”时代,大数据和算力的蓬勃发展是基础,算法是核心。智能算法的不断优化为人工智能的应用带来更多的可能性和发展空间,从而为发展新质生产力提供有力支撑。要想使算法在“人工智能+”环境下发挥跨时代作用,应重构人工智能算法专利认定标准,在专利审查指南框架下明晰专利制度所要保护的算法价值取向,并结合“标准必要专利”概念、“三性认定”、技术标准、技术特征和抽象概念的认定,将人工智能算法所具有的独立价值及独特属性嵌入不同行业作为专利适格性判断标准,从中做出符合时代发展的价值判断与保护,进而实现以新质生产力为发展核心的高水平科技自立自强。
In the era of “artificial intelligence +”,the booming development of big data and arithmetic power forms the foundation,with algorithms at the core.The continuous optimization of intelligent algorithms brings more possibilities and development space for the application of artificial intelligence,thus providing strong support for the development of new productivity.In order to make the algorithm in the “artificial intelligence +” environment to play a cross-era role,it is essential to reconstruct the artificial intelligence algorithm patent identification standards,in the framework of the patent examination guidelines to clarify the algorithm value orientation of the patent system to protect,and combined with the concept of “standard essential patents”.The concept of “standard essential patents”,“three attributes”,technical standards,technical features and abstract concepts,the independent value and unique attributes of general artificial intelligence algorithms embedded in different industries as the patent eligibility criteria,from which to make value judgments and protections in line with the development of the times.This approach aims to achieve high-level technological self-reliance and self-improvement centered on new productive forces.
