“双碳”背景下中国能源立法的目的调整与价值选择

Purpose adjustment and value selection of China's energy legislation under the background of “dual carbon”

科学有效的能源立法是实现能源革命和“双碳”目标的重要制度保障。“双碳”目标不仅是一场关乎中国能源高质量发展的能源革命,而且应为中国能源立法提供新的价值指引。对中国现有能源法律概况进行检视:中国现有能源法律的立法目的、价值取向与“双碳”之间虽有共通之处,但也存在一定张力,影响中国能源高质量发展。因此,建议中国能源立法过程中,应当明确绿色、低碳、可持续的价值目标,坚持以能源效率、能源正义和能源生态安全作为中国能源发展的基本内涵。

Scientific and effective energy legislation is an important system guarantee for achieving the energy revolution and the “dual carbon” goals.The “dual carbon” goal is not only an energy revolution related to the high-quality development of China's energy,but also should provide new value guidance for China's energy legislation.After an overview of China's existing energy laws,it was found there were similarities between the legislative purpose,value orientation and China's energy legislation and the “dual carbon” goals,but there was also conflicts which had affected the high-quality development of energy in China.Therefore,it was suggested that in the process of energy legislation in China,the value goals of green,low-carbon and sustainable should be clearly defined,and energy efficiency,energy justice and energy ecological security should be adhered to as the basic connotations of China's energy development.
