工会视域下新就业形态劳动者权益保障路径探索与创新——以西安市外卖配送员为例

摘要 以新兴信息技术为支撑的平台经济发展浪潮已然来临,推动社会生产和生活方式发生深刻变革,吸纳大量劳动就业,但也存在劳动用工不规范等问题。工会作为亿万职工的“娘家人”,有责任维护劳动者合法权益,推动劳企和谐劳动关系构建。通过积极探索平台经济下工会保障新就业形态劳动者权益实践,以西安市外卖配送员为例,对建会入会、劳动基准、算法管理、社会保险等进行分析,提出工会提质升级阶段发展新要求,从完善劳动基准、社会保险权益和发挥企业民主管理制度优势等方面,探索补齐劳动者权益保障短板,推动劳动关系“和谐号”行稳致远。 The advancement of the platform economy,propelled by emergent information technology,has drastically transformed societal production and lifestyle,concurrently absorbing a substantial workforce.However,challenges such as irregular labor employment exist.As the"home"of numerous employees,trade unions ought to protect employees'rights,and foster harmonious labor relations.This study,utilizing the example of Xi'an takeaway delivery workers,scrutinizes trade union establishment,labor standards,algorithm management,social insurance,etc.It redefines their role during the quality upgrade phase,addresses shortcomings in workers'rights protection through enhanced labor standards,social insurance rights,and the democratization of enterprise management,thereby fostering the sustainable growth of labor relations.
