控权论视野下公平竞争审查制度的理论溯源与路径拓展

Theoretical Origin and Path Expansion of Fair Competition Review System fromthe Perspective of Power Control Theory

随着我国公平竞争审查制度法治化进程和地方实施的推进,围绕该制度的研究火热展开,但是存在一种重制度建构而轻理论探源的倾向,这不利于该制度理论根基的夯实和制度的长远发展。为此,可以基于经济法控权理论深入解析公平竞争审查制度,寻找理论与制度的耦合。经济法控权理论能够为公平竞争审查制度提供广阔的研究视角和正当性基础;公平竞争审查制度则为经济法控权之实现拓宽甚至架构一条现实可行的法治路径,在权力制衡、程序把控、权利彰显、责任追究等具体方面均有所助益。经济法控权与公平竞争审查制度能够相互促进、彼此赋能,共同对政府经济权力制约和市场竞争秩序构建发挥积极作用。

With the advancement of the legalization process of China's fair competition review system and its smooth implementation at the local level,research around this system has become increasingly active.However,there is a tendency to focus more on institutional construction rather than theoretical exploration,which is detrimental to the solidification and long-term devel-opment of the institutional theory.Therefore,it is beneficial to deeply analyze the fair competi-tion review system based on the theory of economic law and power control to find the coupling between theory and institution.The theory of economic law and power control provides a broad research perspective and a legitimate theoretical foundation for the fair competition review sys-tem.In turn,the fair competition review system broadens and even structures a practical legal path for the realization of economic law and power control,contributing to specific aspects such as power checks and balances,procedural control,rights protection,and accountability.The theo-ry of economic law and power control and the fair competition review system can mutually pro-mote and empower each other,playing a positive role in constraining govemment economic pow-er and constructing market competition order.
