摘要
数字经济的发展在给人们生活带来便利的同时,也为个人信息泄露和滥用行为提供了可乘之机,在劳动者个人信息保护方面体现得更加明显。尽管我国已出台多部涉及劳动者个人信息保护的法律法规,司法机关也作出诸多相关判决,但尚未形成体系性,实践中依然存在一定问题。数字经济背景下劳动者个人信息具备的独特之处,为其个人信息保护带来困难,包括“知情—同意”规则虚置、劳动者在收集和处理个人信息等方面处于劣势、劳动者个人信息保护法律法规滞后等。对此,应当拓宽劳动者个人信息保护路径,及时采取以下对策:落实“知情—同意”规则适用范围;规制用人单位收集和处理劳动者个人信息环节的行为;健全保护劳动者个人信息的法律法规体系。
The development of the digital economy not only brings convenience to people’s lives,but also provides opportunities for personal information leakage and abuse,which is more obvious in the protection of workers’personal information.Although China has issued a number of laws and regulations concerning the protection of workers’personal information,and the judicial organs have made many relevant judgments,it has not yet formed a system,and there are still some problems in practice.The unique features of workers’personal information in the context of digital economy bring difficulties to the protection of their personal information,including the absence of“informed-consent”rules,the disadvantage of workers in the collection and processing of personal information,and the lagging laws and regulations on the protection of workers’personal information.In this regard,we should broaden the path of protecting workers’personal information and take the following measures in time:implementing the scope of application of the“informed-consent”rules;regulating the collection and processing of workers’personal information by employers;improving the system of laws and regulations of protecting workers’personal information.
