摘要
刑法学案例课程承载着学生实践能力培养的重要任务,但当前这一课程在教学中被“异化”为刑法学总论、分论理论知识学习的延伸或者补充。这不仅难以与其实践课程的定位与属性相匹配,也无法标榜案例教学的控辩思维与职业素养,逐渐演变为对理论课程内容的重复。对此,有必要从课程衔接的角度出发,明确刑法学案例课程从理论教学到实践教学的“过渡”,在课程设计上突出案例选取、授课目标、授课形式、考核方式的实践化改造,并在此基础上形成刑法学研习“理论课程→案例课程→诊所课程”的体系闭环,从而达致塑造兼具理论能力与实践能力的高素质法律职业人才的理想愿景。
The Course of Criminal Law Case plays a crucial role in cultivating students'practical abilities.However,this course has currently been"alienated"into an extension or supplement of theoretical knowledge in general and specific criminal law studies.This misalignment not only fails to match the course's practical orientation and attributes but also undermines the essential development of critical thinking and professional skills in case teaching,gradually becoming a mere repetition of theoretical content.Therefore,it is necessary to approach this issue from the perspective of curriculum alignment,clarifying the"transition"from theoretical to practical teaching in the criminal law case course.This involves emphasizing the practical transformation of case selection,teaching objectives,instructional methods,and assessment criteria in course design.On this basis,a closed-loop system of"theoretical course→case course→clinical course"can be established,aiming to cultivate high-quality legal professionals with both theoretical knowledge and practical skills.
