摘要
2023年全国消协组织共受理了1328496件消费者投诉,而作为新兴消费模式,电商预售对消费者权益的保障更是亟待规制。虚假宣传屡禁不止、平台自拟的机制缺乏法律依据、“定金不退”条款含法律风险等问题都是电商预售模式下消费者权益保护不容忽视的现实障碍。基于对相关现行法律规章与司法实践的研究,电商预售模式下要加强对消费者权益的保护,依靠细化和补充相关的法律条款,优化平台的立体化治理机制,强化行政指导和行业自律等对策,以促进电商产业高质量发展。
In 2023,the consumers'associations around the country received a total of 1,328,496 consumer complaints,and as an emerging consumption model,e-commerce pre-sales and the protection of consumer rights and interests are in urgent need of regulation.Issues such as persistent false promotion,the lack of legal basis for platform-initiated mechanisms,and the legal risks associated with"non-refundable deposits"are all practical obstacles that cannot be ignored in protecting consumer rights and interests under the e-commerce pre-sales model.Basedon the research of relevant current laws,regulations,and judicial practices,strengthening the protection of consumer rights and interests under the e-commerce pre-sales model relies on refining and supplementing relevant legal provisions,optimizing the platform's three-dimensional governance mechanism,and strengthening administrative guidance and industry self-discipline,so as to promote high-quality development of the e-commerce industry.
