数字社会老年人的权利困境及回应进路--基于三维义务构想

The Rights Dilemma and Response of the Elderly in the Digital Society-Based on Three-dimensional Obligation Conception

社会的数字化转型实现了经济效率和治理效能的显著提升,但也引发了老年人权利损害现象。数字化和老龄化交汇共进,基于衰老、疾病、贫困的交叉作用,老年人的隐私权、个人信息权、健康服务权和社会参与权都面临严重困境。多维贫困致使的脆弱性、年龄歧视的甚嚣尘上和社会支持体系的构建乏力,共同导致数字社会老年人的权利困境。基于此,在应然层面,要致力于从“自治神话”到依赖理论、形式平等到实质平等、外界赋权到内在增能的理念转变;在实然层面,要实现国家义务设置、社会义务安排和公民义务分配,尽可能全面有效地破解数字社会老年人的权利困境。

The digital transformation of society has significantly improved the economic efficiency and governance efficiency,but it has also triggered the phenomenon of the damage to the rights of the elderly.Digitalization and aging go hand in hand.Based on the interaction of aging,disease and poverty,the rights of privacy,personal information,health service and social participation of the elderly are all facing serious difficulties.Vulnerability caused by multidimensional poverty,rampant age discrimination and weak construction of social support system all lead to the rights dilemma of the elderly in digital society.Based on this,we should devote ourselves to the conceptual transformation from“the myth of autonomy”to dependence theory,from formal equality to substantive equality,and from external empowerment to internal empowerment.On the practical level,it is necessary to realize the national obligation setting,social obligation arrangement and citizen obligation distribution,and solve the rights dilemma of the elderly in the digital society as comprehensively and effectively as possible.
