在全面依法治国方略深入推进的背景下,司法确认审查在司法权落实及调解过程中的重要性日益凸显。在案件检视中发现,司法确认程序审查仍存在审查规则不统一、审查内容多样化、审查范围超范畴、虚假调解难预防等问题,从明确审查规则、统一审查内容、统一审查范围、防范虚假调解等层面,对司法确认程序审查规则提出检视与优化措施。

In the context of deeply advancing law-based governance,the importance of judicial confirmation review in the process of judicial power implementation and mediation has become increasingly prominent.In the examination,it can be seen that the review rules of judicial confirmation procedure exist such phenomena as non-uniform review rules diversified review content,extra-scope of review,and false mediation which is hard to prevent.Accordingly,review and optimization of judicial confirmation procedure review rules are put forward,such as unifying review content and scope,and preventing false meditation.
