行政救济法视域下行政争议实质性化解机制研究

Research on the Substantive Resolution Mechanism of Administrative Disputes from the Perspective of Administrative Relief Law

从私主体权利救济的视角观察,行政复议、行政诉讼和行政检察监督分别位于行政争议法治化解决渠道的前端、中端和后端,三者共同构建起我国行政救济法框架下的行政争议正式解决路径。综合考察三种法定制度下的两种实质解纷模式,发现存在着行政主体自行纠错机制缺失、行政复议调解机制不完善、法院实质解纷整体效能有限、检察机关实质解纷依据不明确等问题。为此,应当在建立健全行政争议实质性化解组织体系的基础上进一步加强相关领域立法、完善各项具体工作机制,使行政主体、行政复议机关、人民法院和人民检察院能够找准各自定位、依法尽职履责。

From the perspective of private subject rights relief,administrative reconsideration,administrative litigation,and administrative procuratorial supervision are located at the front end,middle end,and back end of the legal resolution channels for administrative disputes,respectively.Together,they form the formal resolution path for administrative disputes under China’s administrative relief legal system.By comprehensively examining the two substantive dispute resolution models under these three statutory systems,it can be found that there are problems such as the absence of an administrative body’s own error correction mechanism,the imperfection of the administrative reconsideration mediation mechanism,the limited overall effectiveness of the court’s substantive dispute resolution,and the unclear basis for the procuratorate’s substantive dispute resolution.Therefore,on the basis of establishing a sound organizational system for the substantive resolution of administrative disputes,further strengthening legislation in related fields and improving various specific working mechanisms is necessary to enable administrative bodies,administrative reconsideration organs,people’s courts,and people’s procuratorates to accurately find their respective positions and actively fulfill their duties.
