平台媒介的兴起:隐私保护的范式与悖论

摘要 隐私与媒介之间存在复杂的张力关系,它们既相互对立又相互依赖。考察隐私的概念传统、媒介的历史演化以及两者之间的相互塑造,可以揭示隐私与公共、隐私与媒介之间复杂的冲突和共生关系。这种关系涉及信息的保密与公开、信息的保护与传播以及个人隐私权利与公共媒介自由之间的协调。伴随平台媒介的兴起,传统的隐私保护范式面临控制悖论、匿名化悖论、个人可识别信息悖论、被遗忘权悖论和信息涉他悖论等挑战,隐私保护与媒介公共传播的法律生态平衡面临深刻危机。需要在主流的“架构—规范—市场—法律”监管框架基础上,探讨新的制度可能性,推动隐私保护与公共媒介自由之间生态平衡关系的重建。 The relationship between privacy and media is marked by a complex tension,characterized by both opposition and interdependence.By examining the traditional concept of privacy,the historical evolution of media,and the interplay between the two,one can uncover the intricate conflicts and symbiotic relationships between privacy and the public sphere,as well as privacy and media.This relationship involves the balance between the confidentiality and public dissemination of information,the protection and propagation of information,and the coordination between individual privacy rights and the freedom of public media.With the rise of platform media,traditional paradigms of privacy protection are confronted with challenges such as the control paradox,anonymization paradox,PI paradox,right to be forgotten paradox,and third-party information paradox.These challenges bring the legal balance between privacy protection and public media communication into a profound crisis.It is necessary to explore new institutional possibilities within the mainstream regulation framework of"architecture-norm-market-law",to rebuild the ecological balance between privacy protection and media freedom.
