The evolution of the metaverse in terms of technology and application demonstrates its characteristic as a fusion of virtual and reality,formed when virtual reality technology reaches a certain level of sophistication.The essence of infringement behaviors in metaverse virtual scenarios lies in the inappropriate penetration from the virtual world into the real world.Based on the presence or absence of such penetration and the way it occurs,two sets of key factors,"internality/externality"and"program compliance/program violation",can be identified.The combination of these factors can encompass the range of behaviors within metaverse virtual social scenarios,delineating the scope of"genuine issues"for research.Virtual property transfer,due to its proprietary nature,can lead to virtual-real penetration.Sexual harassment,because of the inherent identity between virtual and real personas in terms of mental interests,can also result in virtual-real penetration.By clarifying these judgment factors and categorizing behaviors accordingly,one can conduct analyses on decriminalization and criminalization,thereby validating the effectiveness of a two-stage analysis from technical principles to criminal law principles.
