构建数字经济治理的法治路径

Constructing the Legal Path for Digital Economy Governance

在数字经济治理方面,我国主要运用政策和法律两类手段。应有效处理“政策与法律”的关系,将行之有效的数字经济政策及时上升为法律。鉴于在平台经济治理、数据治理和人工智能产业发展规制等具体领域,以及在贯穿上述各领域的基础制度方面,都存在影响市场主体“制度预期”的突出问题,应着力从良法与善治两个层面,构建数字经济治理的法治路径。为此,在数据治理、数字产业发展等重点领域,应加强相关价值引领,推进数字经济立法的体系化,从而构建“良法”;同时,还应将包容审慎原则贯穿执法和司法,优化执法机构和司法机关的权力配置,保障平台企业、消费者等主体在数字经济治理方面的参与权,实现多元主体的协同共治,从而持续推进“善治”。依循上述数字经济治理的法治路径,更有助于保障市场主体的“制度预期”,切实在法治轨道上促进数字经济的有序健康发展。

In the governance of the digital economy,China primarily relies on both policy and legal measures.To address the previous tendency of"emphasizing policy over law,"it is crucial to effectively manage the relationship between these two approaches by elevating effective digital economy policies into formal legislation.Given the prominent issues affecting"institutional expectations"of market entities,such as in platform economy governance,data governance,and the regulation of artificial intelligence industries,as well as in the foundational systems that underlie these areas;there is a need to construct a rule of law path for digital economy governance from the dual perspectives of"good law"and"good governance."This involves strengthening value-oriented guidance and promoting systematic digital economy legislation in key areas such as data governance and digital industry development to create"good law."Additionally,the principle of inclusiveness and prudence should be consistently applied in law enforcement and administration of justice,optimizing the distribution of powers among enforcement agencies and judicial bodies,and ensuring the participatory rights of platform enterprises,consumers,and other stakeholders in digital economy governance.This approach facilitates collaborative governance among multiple entities,thereby advancing"good governance."Adhering to this rule of law path in digital economy governance will better safeguard the"institutional expectations"of market participants and effectively promote the orderly and healthy development of the digital economy within the framework of the rule of law.
