民营经济专项立法的理论依循与制度进路

Theoretical Basis and Institutional Progress of Special Legislation on Private Economy

民营经济在我国经济体制中占有重要地位,但现有立法存在体系化水平不高、政策稳定性不强、实践可操作性较弱等问题,有必要进行专项立法。对民营经济而言,该立法应发挥规范平稳发展、保障地位平等与促进做大做强等作用,秉持发展与治理并重、倡导与规制并用、竞争与互利并行的立法理念,坚持“两个毫不动摇”,正确处理政府与市场、改革与发展的关系,从守法经营、公平竞争、财税金融等方面展开规范性、保障性和促进性制度设计,从而为民营经济的高质量发展提供法治保障。

The private economy occupies an important position in China's economic system,and the existing legislation has problems such as low systematization,insufficient policies stability and weak practical operability,which makes it necessary to enact special legislation.The legislation has multiple meanings such as regulating stable development,ensuring equal status and promoting growth and strengthening.It should adhere to the legislativeconcept of giving equal importance to development and governance,advocacy and regulation,competition and mutual benefit,adhere to the basic principle of"two unswervingly",correctly handle the relationship between government and market,reform and development,and carry out normative,protective and promotional institutional design from the aspects of law-abiding operation,fair competition,taxation and finance,so as to provide legal guarantee for the high-quality development of the private economy.
