摘要
教育法典编纂是教育立法的系统性活动,家庭教育应在其中得到妥适的安放,并独立成编。家庭教育入典的主要困境体现在家庭教育与其他教育类型之间、以及家庭教育法与传统教育法的定位之间都存在较大差异,且现有立法体量较小,易造成教育法典的体系失衡。将家庭教育纳入教育法典并独立成编,突破了传统部门法藩篱,符合教育法作为领域法的基本定位,也是诠释教育事业整体内涵,提升教育立法质量的实践需求。应从价值宣导、体例编排、内容完善等方面考虑家庭教育的法典化路径,从家庭教育法律规范中提取出一般性规定,经过整合吸收后在总则编中加以规定。分则的家庭教育编需要从科学界定相关主体权责、健全家庭教育指导服务体系、明确司法保障的限度和方式等方面进行内容完善。
Compilation of Education Code is systematic education legislation.Family education should be properly placed in it as an independent chapter.The main difficulties in enacting family education are reflected in the large differences between family education and other types of education,as well as the positioning between family education law and traditional education laws.The small volume of existing family education law may be easy to cause the imbalance of the system of Education Code.Incorporating family education into the Education Code and compiling it independently breaks through the barriers of traditional departmental laws,conforms to the basic positioning of education law as a domain law,and is also a practical demand for interpreting the overall connotation of education and improving the quality of education legislation.The codified path of family education should be considered from the aspects of value promotion,style arrangement and content improvement.The general provisions are extracted from Family Education Promotion Law and are formulated in the general provisions after integration and absorption.The specific provisions should be improved from the aspects of defining rights and responsibilities of relevant subjects scientifically,perfecting the family education guidance and service system,and clarifying the limits and ways of judicial protection.
