摘要
高校教育惩戒权包括惩戒设定权与实施权。研究发现,高校教育惩戒权在实践中存在条文设计较为笼统、越权设定身份性惩戒、违反正当程序原则、没有就证据进行严格的关联性调查等问题,面临立法、机制、定位三重困境。应明确高校教育惩戒的概念及性质,确立各实施主体的权力边界,优化高校教育惩戒权实施机制,构建多部门联动的校内救济体系,重视政府、家庭和社会组织在教育惩戒过程中的作用。
The educational punishment power at colleges and universities includes the power to set and implement disciplinary measures.Research has found that in practice,the educational punishment power at colleges and universities has problems such as vague provisions,setting identity-based punishments beyond authority,violating due process principles,and not conducting strict correlation investigations on evidence,facing a triple dilemma of legislation,mechanism,and positioning.The concept and nature of disciplinary action at colleges and universities should be clarified,the power boundaries of each implementing entity should be established,the implementation mechanism of disciplinary action in higher education should be optimized,a multi-departmental collaborative internal relief system should be constructed,and the participation of the government,families,and social organizations in the process of disciplinary action should be emphasized.
