城市更新背景下历史建筑的法律界定

Legal Definition of Historical Buildings in the Context of Urban Renewal

摘要 城市更新背景下需要在法律层面对历史建筑进行界定和保护,国外历史建筑的法律界定已经形成了指定制、登录制以及双轨制三种典型的界定模式。我国对法定的历史建筑区别于文物建筑、传统风貌建筑等进行保护,形成了以指定制为核心的历史建筑保护法律体系,但存在历史建筑法律概念的逻辑错误、保护制度的单一性和地方认定标准不统一等问题。为此我国需要进行历史建筑概念的再界定,采用指定制和登录制相结合的界定模式,建立历史建筑界定的中央统一立法,构建中国特色的以历史建筑为代表的文化遗产法律保护模式。 In the context of urban renewal,it is necessary to legally define and protect historical buildings.The legal definition of historic buildings abroad has established three typical definition models:designation system,registration system,and dual-track system.In China,the protection of legally designated historical buildings is distinct from that of cultural relics and traditional architectural styles,forming a legal system for the protection of historical buildings with the designation system as the core.However,there are problems such as logical errors in the legal concept of historic buildings,the singularity of the protection system,and inconsistent local identification standards.Therefore,China needs to redefine the concept of historical buildings,adopt a definition model that combines the designation and registration systems,establish unified central legislation for defining historic buildings,and develop a legal protection model for cultural heritage represented by historic buildings with Chinese characteristics.
