摘要
《反不正當競争法》第9條第4款規定:本法所稱的商業秘密,是指不爲公衆所知悉、具有裔業價值并經權利人採取相應保密搭施的技術信息、經營信息等商業信息。該條款既是確定商業秘密的構成,也為商業秘密保護提供遵循。
Article 9.4 of the Anti-Unfair Competition Law reads that"for the purpose of this Law,a trade secret means any commercial information unknown to the public,including but not limited to technology or business information,with commercial value and for which its lawful holder has taken proper confidentiality measures."
