数字艺术图像授权交易平台建设研究

艺术品的数字化不但可促进文化传播与交流,更可以延续艺术品之价值,增值应用创造商机。然而过往数字图像交易多采用传统交易模式,并以集体管理授权为主。数字科技的进步、物联网的发达推动了整个社会的信息共享,从而也冲击到知识产权作为“私权”的本质,打破了传统交易中权利人、利用人及中介者的界限,并随之带来适合个体的著作权授权交易趋势。本研究以建立适合个体的艺术品数字图像授权交易平台为目的,首先,以数字图像授权交易中可能触及的著作权为核心,探讨数字环境下著作权授权增值利用的挑战,以及相应产生的新型著作权授权模式。其次,分析国外现行数字图像交易平台以及数字图像授权交易平台应具备的功能。并采用调查问卷,以艺术家为调查对象,针对艺术品数字图像交易平台功能的期望进行调查,以期为未来创作者或相关从业者构建艺术品数字图像授权交易平台提供参考途径。

The digitization of artworks not only promotes cultural dissemination and exchange but also extends the value of artworks and creates business opportunities through value-added applications.However,digital image transaction has centered around traditional trading models in the past,primarily governed by collective management authorization.The advancements in digital technology and the development of the Internet of Things have propelled information sharing throughout society,impacting the essence of intellectual property as a“private right”and blurring the boundaries among rights holders,users,and intermediaries in traditional transactions.This has led to a trend of copyright authorization transactions that cater to individuals.This study aims to establish a digital image authorization trading platform for artworks tailored to individuals.Firstly,focusing on copyright which may be involved in digital image authorization transactions,the challenges of value-added utilization of copyright in a digital environment was explored,as well as the emergence of new copyright authorization models.Secondly,the existing digital image trading platforms abroad were analyzed to identify the necessary functions of a digital image authorization trading platform.Then a survey was conducted targeting artists to assess their expectations regarding the functionalities of such platforms,aiming to provide reference pathways for constructing a digital image authorization trading platform for future creators or related practitioners.
