电竞酒店的法律性质认定及监管路径探析

An Analytical Study of the Identification of the Legal Nature and the Supervision Path of E-sports Hotel

从电竞酒店法律性质界定这一源头性问题出发,在认定电竞酒店为“新型住宿业态”的基础上,分析当前电竞酒店行业面临的缺乏明确依据导致的监管滞后、主体责权不明导致的监管无序、未能凸显特殊性引起的监管内容同质化等困境,并提出抓住监管依据、监管主体、监管重点三方面完善电竞酒店监管的对策建议,以期推动电竞酒店行业健康可持续发展。

By determining the legal nature of E-sports hotels as a new business form of accommodation,this paper analyzed the problems that such hotels currently face,including slow regulation due to unclear basis,chaotic regulation resulting from the ambiguity of the power and duties of entities,and homogenization of regulation owing to the lack of attention to the particularity of such hotels.In order to facilitate the healthy and sustainable development of E-sports hotels,this paper proposed to perfect the regulation from the aspects of regulatory basis,entities,and priorities.
