摘要
随着依法治教、依法治校的深入发展,法治工作测评作为一种治理方法在高等教育治理中得到应用。源于量化法治的观念,通过设计一套合理的指标体系对高校依法治校的成效予以定量评价,从而在高等教育治理中发挥着规范指引、精准施策和风险预防等多重功能。从高等教育治理的价值意蕴检视,法治工作测评仍需不断适应高等教育治理现代化的目标要求,实现从工具型治理、政府主导型治理、政策型治理向价值型治理、府校合作型治理和法治型治理转变。为此,优化法治工作测评应该注重多元治理主体的联动和多种测评指标的运用,完善测评数据的公开和归集,最终实现法治工作测评的法律化。
With the deepening development of governing education and universities according to law,the legal work evaluation has been applied as a governance method in higher education governance.Originating from the concept of quantifying the rule of law,a reasonable indicator system is designed to quantitatively evaluate the effectiveness of legal governance in universities,thereby playing multiple functions in higher education governance,such as normative guidance,precise policy implementation,and risk prevention.From the perspective of the value implications of higher education governance,the legal work evaluation still needs to continuously adapt to the requirements of modernization of higher education governance,and achieve a transformation from instrumental governance,government led governance,and policy-based governance to value-based governance,government and university cooperation-based governance,and rule of law-based governance.Therefore,optimizing the legal work evaluation should focus on the linkage of multiple governance entities and the use of multiple evaluation indicators,improve the disclosure and collection of evaluation data,and ultimately achieve the legalization of legal work evaluation.
