摘要
互联网发展降低了私人复制成本,提升了数字作品易得性,便利了版权侵权行为。与一般的版权禁令制度相比,版权动态禁令制度允许将后续出现的镜像网站涵盖在其适用范围之内,有效提升了打击网络版权侵权的效率,符合版权禁令制度制止侵权的宗旨,且与我国现有制度衔接不存罅隙。故我国应引入版权动态禁令制度,以促进数字时代版权产业的发展和版权人的保护。通过梳理剖析,我国应以解释论和修正后的一次申请模式作为制度设计的框架基础。在具体的制度建构上,应通过比例原则审视版权动态禁令制度个案适用的可能性,借助既有法律规范框定的架构将后续识别侵权网站的举证责任和通知屏蔽的义务合理分配,并以降本增效为价值指引对版权动态禁令制度执行阶段的费用承担和有效性评估作出妥切安排。
The development of Internet has reduced the cost of private copying,improved the availability of digital works and facilitated copyright infringement.Compared with the general copyright injunction system,the copyright dy⁃namic injunction system allows the subsequent mirror websites to be included in its scope of application,which effec⁃tively improves the efficiency of cracking down on online copyright infringement,conforms to the purpose of the copy⁃right injunction system to stop infringement,and has no gap with the existing system in China.Therefore,China should introduce the dynamic prohibition system of copyright to promote the development of copyright industry and the protec⁃tion of copyright owners in the digital age.Through combing and analyzing,China should take the explanatory theory and the revised one-time application model as the framework basis of system design.In the concrete system construc⁃tion,we should examine the possibility of the application of the copyright dynamic injunction system through the prin⁃ciple of proportionality,rationally allocate the burden of proof and the obligation of notification blocking for subsequent identification of infringing websites with the help of the framework of existing legal norms,and make proper arrange⁃ments for the cost bearing and effectiveness evaluation of the copyright dynamic injunction system in the implementa⁃tion stage with the guidance of reducing costs and increasing efficiency.
