A Study of the Risks and Ethical Regulation of Generative AI Applied to the Literary Writing

随着人工智能技术的发展,由算法驱动的自然语言处理系统ChatGPT正不断完善,在多个领域内实现应用。然而,在技术监管缺失、侥幸心理作祟等因素的推动下,ChatGPT写作的负面影响逐渐渗入文学作品创作、出版领域,导致创作不端现象出现。由于算法黑箱、标准缺失等情形的客观存在,文学创作等领域对于判定文学工作者是否使用ChatGPT写作存在一定困境。基于ChatGPT写作鉴定难、取证难、追责难等问题,应在落实原有创作规范的基础上正确认识ChatGPT,做到开发与监管相结合,同时通过加强个人能力及创作道德培养、完善相关法律机制等方式对ChatGPT代写文学作品起到恰当规范、约束作用。

With the development of artificial intelligence technology,ChatGPT,a natural language processing system driven by algorithms,is continually improving,realizing applications in several fields.However,driven by factors such as lack of technical supervision,and a sense of fluke,the negative impact of ChatGPT writing has gradually seeped into the field of creation of literary works and publication,leading to the emergence of creative misconduct.Due to the the existence of black box algorithms and lack of standards,editors and other publishers have certain difficulties in determining whether ChatGPT writing is used by literary creators.Based on the problems of identification,forensics and accountability of ChatGPT writing,on the basis of the implementation of the original academic norms,ChatGPT should be properly recognized and the combination of development and supervision should be achieved.At the same time,by strengthening the cultivation of personal ability and literary creation ethics and by perfecting the relevant legal mechanisms,ChatGPT writing literary works should be properly regulated and constrained.
